    Sorry Moose but I think this is a bit naive. I hate to say it but I do think “positive discrimination” is an issue in many private sector industries. A friend of mine worked for one of the biggest global accountancy/consultancy companies. When it came to deciding who should be promoted within his team, he was told in no uncertain terms that a certain number of promotions HAD to go to members of the team who were not male or white. So he was forced to promote a couple of younger, less experienced team members ahead of those who, at that time, actually deserved the promotions more. As a woman I hate this as much as I hate the misogyny that still exists and sometimes prevents women getting the recognition they deserve. Reward me based on my achievements regardless of my gender or race, not to tick a box.

    I know a chap who we recruited during the worst of the pandemic who was over 60. He just got another job at a competitor for a big pay rise. Maybe it's the sector we're in but a lot of us specialists are well into our 50's.

    If this story is true, I have no respect for your friend. Have some cojones and do the right thing, not just gossip afterwards. What you are describing isn’t lawful and what’s his job as a manager for if he doesn’t make any actual choices? If he’s happy to cheat colleagues out of a promotion on the basis of their race or gender?

    You may be right that some of this behaviour goes on. After all, many private sector companies used to promote exactly who they liked on the basis of chaps being one of the club, having the right accent and the right tie. So maybe they still do what they want. I can tell you that the public sector, while it makes lots of efforts to advance diversity and attract a wide field, still makes fair choices. And yet we have Private looking down on Public as if we don’t know what we are doing. It sounds like we are light years ahead.

    But I just wonder whether people, who were used to see the workplace look one way cannot get used to it changing and are letting their prejudices run riot. The result is that female or minority advancement is always met with suspicion as if no one is ever really good enough and they must have had someone, somewhere fix it for them at the expense of some poor old middle class duffer.

    When I first started for the company I work for now, I was bottom rung of the team, despite my experience in the field and the fact I had led various projects very successfully in previous roles. When I say "bottom rung" I meant it. To most people I was the level of janitor, despite being far more experienced that some the "college kids" who had somehow wormed their way in off a Computer Science Degree just because they can write the 'Hello World' program in five different languages.

    I spent a lot of my early months actually helping out the newer people, who still looked down upon me. I pondered for a while at the reason then I noticed I had boobs. There are a three females myself included who work in the sector unit block I do. Not to say the males are sexist, or woke or whatever you call people these days, but it was clear from the get go they had their little groups and pockets of sniggering. When it came to promotion, my name was always put forward and even the line manager (who was a pr!ck) thought I was worthy. But the decision was to promote three of the newbies who I had been quite frankly "hand held" through various projects. I was shell shocked when I heard the reason it was because they thought/assumed a woman could not lead a team of men.

    A year or so later when the option for a new team leader came up (Elon Musk was in the process of launching various new SpaceX projects) I wanted to be part of the teams, so I put myself forward and got nominated by almost everyone in the room. In the end the vote was tie and the decider went to the line manager who chose somebody else over me. To say I was not happy was an understatement. It then came about the vote was rigged, and I finally got in due to the line manager being rightly fired. To this day I still am project leader on various projects and I still help everyone out remotely now. Our department now handles out-sourcing of software creation and maintains legacy code written in Ada and Pascal. I just rambled a lot I know, but this subject and your post made me remember those days, and still there are only the three of us ladies on the team. I know I.T is a male dominate industry, but I am proud of what I do and have a achieved a lot. I just wish more females were getting into software development.

    The story is true and my friend’s hands were tied - basically it was tick the diversity boxes with at least a couple of the promotions or none of the ones he put forward would be approved. So, yes, he could have refused to play ball - and none of his team, including those who deserved it, would have got recognition for the hard work they’d put in. I’m sorry but again it shows naivety on your part if you think he could just throw his toys out of the pram. And if you notice, in the original post I said “worked”. He has now left the company.

    It is extremely naive to think a lot of companies in the private sector don’t just do exactly what they want regardless of whatever the law is, the vast majority of the time they get away with it as well.

    I worked at the same company as my ex business partner for a while, I left a while before him and he eventually got made redundant. It was between him and another much younger girl who kept their job. They just took him in a room one day and said we’re making you redundant and keeping her, despite him being significantly more experienced and a consistently better performer than her (it was a sales role and his numbers were always without fail much better than hers) he sought legal advice and they told to him to request a subject access request so he could see the scoring system they’d based the decision on. They couldn’t produce one because there wasn’t one, there is no actual legal scoring system that would’ve placed her ahead of him. They ended up having to give him a years wages so he didn’t sue them.

    In another example, they made a pregnant woman redundant but simultaneously recruited somone for her exact same role in Amsterdam. She wouldn’t have taken the job in Amsterdam, but the point was legally they had to offer it to her and they didn’t, they just thought they could get rid of her while pregnant with no issues, again they had to pay her off.

    I know it’s not exactly the same thing as being discussed, but it’s incredibly naive to think private sector business aren’t often run how the powers that be want them run, as opposed to what the law actually says.

    That doesn’t make sense. Why would the company not promote anyone at all because of an objection to its lawbreaking? Why didn’t he get advice from HR? Why didn’t he speak to the whistleblowing charity, PROTECT?

    I find it ironic you think I’m naive in this, when you present it as necessary to work with no personal red lines.

    Our lead developer was female and by far the best we had. The pandemic hit and the dev team worked from home without a single issue. The pandemic ended and they were told to come back in. They asked why when they were more productive at home. The company didn't bend and she left. It was a disaster. Then they introduced flexi weeks for the dev team so only 2 days out of five that they needed to be in. The damage was done and we lost another 3 awesome developers.

    Even now we're struggling to recruit the right people. Good old HR eh?

    I can tell you a fact that it doesn't.
    The importance of being able to tick boxes drives a great deal of senior management appointments in the public sector atm.
    You are right that you cannot advertise that "only ethnic minorities should apply" for example, but there are ways around this to achieve what you want without breaking the law. For example "The ability to speak fluent hindi would be an advantage" is perfectly legal where a section of the local population is from that ethnic group and speaks limited english, whether or not that is truly required.
    I've often managed the HR functions of organisations I've worked for. There was always a way to appoint who we wanted to appoint to a new role or make someone redundant that we wanted to remove. For example "sickness days" was a valid selector for redundancy. If it was a unique position, make the role redundant and then restate the role 3 months and one day later (if within 3 months you have to offer back to the staff you made redundant).

    That is truly awful, and HR in a lot of companies need to to be taken into account and held to criticism for over stepping the line. I'm actually in favour of flexi weeks as working in the home environment can make you more at ease, but then again I also enjoy the office space as collab face to face is much more grounded. I hope she is doing well, as are the developers who have left. So many roles now have such fast turnover that it's almost impossible to keep up.

    I like Gin, but I don’t think we need all the different types and once mixed with tonic you really can’t tell the difference between most of them.

    Im talking about normal gin as opposed to flavoured ones obviously.

    I could also extend that to IPAs, I really don’t think we need so many of them and a lot of them taste the same.
