Ched Evans - Case goes to appeal

    If you're speaking from experience, surely you know that what is reported is a fraction of the evidence in any case and it's therefore dangerous to make any assumptions about how strong or weak the evidence is? You'll also know that a jury will be able to watch the behaviour of the defendants and witnesses giving evidence and under cross-examination, and make an assessment as to the credibility of their answers. You don't know that the evidence was flimsy, it's an interpretation that you have placed on what's been reported.

    A retrial must also cast doubt on McDonald's getting off with it. Will the CPS move to retry him too?

    Again, no. This ruling from the Court of Appeal is not saying there was anything wrong with the verdict reached at the original trial on the evidence presented at the time. It's saying that there is something else that should have been considered by the jury and may have assisted Evans. McDonald doesn't come into it.

    The transcript of the case is public. Many reporters will have examined the transcript and reported on what they saw as the relevant bits of evidence. I am sure that if there was some damning evidence, we would know about it.

    As for what the jury sees. I don't know how Evans and the victim came across. But I do know that I have seen absolute liars come across as absolute saints, in court, and vice versa. Juries are fooled all the time.

    ...and yes, my opinion was an interpretation of whats been reported. Just like everyone else's is, unless they were in the hotel room at the time.

    Oh then sorry, I misunderstood.

    To be honest the CPS stand to lose a lot of face whatever they do and would risk more by losing a retrial, however IMO they probably feel they have to.

    Does anyone on here know whether the CPS are obliged to re-run the same case in a retrial, or could they bring different angles of attack with further "new" evidence?

    It's a fresh trial. The clock is essentially reset as if the first trial never occurred.

    Without doubt there would be a massive backlash from all kinds of women's organisations if the CPS decided not to proceed ... even if it proves to be a bit of a sham, a new trial is probably unavoidable.

    No idea what the retrial numbers shake out to in the UK, but in the US the defence is quite strongly favoured in a retrial. Be interesting to see how this all shakes out.

    Considering McDonald got off you'd have to say it was borderline anyway. Any new evidence suggesting innocence could be enough to swing it IMO.

    It now seems the basis of the appeal was that two people who didn't come forward at any point during the initial investigation or high profile trial chose to come forward and give evidence this time around. Unless the police were completely incompetent in not finding those people I can't see any retrospective action he can take. He was convicted based on the evidence at the time. Whatever their motives - and I know the CPS made a big play on the financial reward offered by Evans' team - more people came forward and changed the evidence such that a jury have now found him not guilty. That's our system. It's imperfect in many ways but it doesn't mean he's due compensation.

    What's that got to do with anything? I never commented on whether or not it was rape or consensual sex. I said the girl herself didn't report a rape, which is a fact, making your comments on her being a vile disgusting **** baseless.

    I'd say that falsely accusing someone of rape in court is a pretty vile and c**tish thing to do.

    I just hope that all those people that were so quick to brand him a rapist just because a court said he was are now equally keen to publicly celebrate his complete innocence.

    The jury found that they were unable to convict Evans beyond reasonable doubt. That is not to say that he didn't rape her or that he has been found innocent of rape, just not guilty. The court has not proven that the complainant was lying. But then you already knew that obviously.

    And I'm not a vicar, Godfather. You're the misogynist who calls sexually active young girls bikes and c**ts, but defends a local 'lad' with a girlfriend who lies to get a key to get into a hotel room, watches two people have sex, asks to join in and performs oral sex on a massively drunk girl immediately after his friend has had unprotected sex with her. Local 'lad' them proceeds to leave the hotel through the fire escape leaving the young girl to wake up alone in the morning, terrified and not knowing what has happened. Just a typical Saturday night for a young 'lad' eh?
