    '...we unanimously vigorously reject the plans...considering all actions available to prevent it from progressing, as well as holding those Shareholders involved to account under its rules.'

    Unlikely, of course, but I think it shows how far those behind this idea are ready to go to get it launched without suffering any consequences. I am still unconvinced they could use any arguments that it is ‘unfair’ to disallow ESL clubs access to FA/UEFA competitions when the ESL itself will not allow similar access, but maybe they’re convinced they can win that argument in court.
    I think the issue with banning players from representing their countries will be a tougher one to enforce, at least with any player who is already under contract to one of these clubs, as they should not be directly punished for actions of their employers that are beyond their control. However, it should be feasible for FIFA to disallow any player access to their approved competitions, such as World Cup, if they decide to sign for one of those clubs, or extend their contracts, once due warning has been given.

    But as LTC68 says, Parliament can legislate in respect of football in this country in whatever manner it wishes. It doesn't matter whether this produces fair or unfair consequences.

    As for 'should not' be punished for the actions of their employers - perhaps, but that is a question of morality rather than of law. It presumably depends on what sanctions are avaulable to FIFA under its rules.

    I was not talking purely about the English teams, but the thing in the whole, so I am aware that the 6 EPL clubs could well have the rug pulled from under them. I think even the clubs from the EU will struggle to win in court if they have to argue on the basis of unreasonable disallowance of access, or competition criteria, as both of those elements are demonstrably precluded in the very set up of the ESL.
    I’m not sure it would be necessary to ban currently contracted players from international competition...the very fact of the inclusion of an ex hoc ban on all signatories to new and/or renewed contracts would have a very similar effect, especially as those players would have taken the conscious decision to sign.
    Does the concept of punishing employees for the actions of their employers exist in current UK law?

    No, I realise that but presumably if the 6 have to withdraw because it becomes unfeasible due to some form of UK legislative intervention, the whole thing would collapse like a house of cards.

    I guess the latter question is governed by employment law in this country but if you are talking about precluding international representation that would, I assume, be governed by FIFA rules so I don't think it's a question of English law. If I'm wrong about that then I guess Parliament could legislate to that effect although that strikes me as a step which would reluctantly be taken, in part for the reason you suggest.

    If this is a bargaining chip then the obvious thing about any sort of threat working is that the other party need to believe the threat is real, and that you’ll go through with it. Seeking legal advice is the minimum you’d expect them to do, whether this what they actually want to do or not, it needs to look real and stand up to scrutiny to be effective.

    Based on the reactions from the Gov't/PL/UEFA/Fans/Media/Broadcasters I can't see how it can happen. I wonder what the fallout will be? They'll probs end up getting more money out of it and just carrying on as normal, like nothing ever happened.

    I imagine the clubs involved have learned a lot and, if this one doesn't come off, they'll be back again within a decade probably with governments paid off and having got their people into power in UEFA/FIFA to clear the way.

    If the government can/will block it then I can’t see how it can happen, unless it becomes in everyone’s interests for it to happen. I can’t imagine the scenario that would need to unfold for that to be the case.

    If it was a case of just ripping up the blueprints drawn up, then maybe. But as I said elsewhere, they have withdrawn from the ECA and their execs resigned their positions - they have walked away from the group set up to shape the current European game and been replaced by individuals from other clubs already.

    If they abandon their plans now, they are in a much weaker position than they were in on Sunday morning. And those clubs still involved in the ECA won’t trust them whatsoever anymore and are pretty unlikely to allow these clubs back into their powerful roles. They’d somehow have to get everyone else to agree to disband the ECA and setup a new organisation that is more in tune with their wants and desires. Given their actions of the last 48hrs, I think their chances of that are zero.

    Can you see these 12 clubs coming back weaker than before given the nature of their complaints?

    I’d love a situation where they come back with their tail between their legs, taking their punishments without complaint and showing their bruised egos for all to see without defence....but I cannot see it at all, yet I think that’s what this needs for this to go away (for now). It’s the only outcome that will be palatable for fans and other clubs.

    Another reason why I sort of wouldn't be too sorry if we didn't go up.

    I'd rather watch Carl ****inson in Division 4 than watch couldn't care mercenary types playing European greedball for the benefit of the TV.

    If failing to go up also knocks the prospective stadium move on the head, then so much the better.

    A knee-jerk reaction wouldn't be wise. They need to consider all the options and the positions that will be taken by the fans' representatives, Prem 14, the EFL, the PFA, FIFA and UEFA, and the Government and opposition - and the legal advice obtained by all these parties. Oh - and the broadcasters.

    Why do people say sky took it away? The sellers (football) had the choice who to sell to and who would then have access. It is totally the choice of the football authorities/teams.

    Woodward to fall on his sword and will step down this year. The dominos are falling now. Looks like the ESL is doomed.

    I hope the governing bodies and national governments don't let this go, though. This needs to be a kindle for serious football reform, and taking the game back from the super rich clubs. They're outnumbered. Time to show them what that means.

    They should do the honourable thing and give them huge fines as well. These reprobates need to be put in their place for once and for all otherwise in a few years they will be coming up with another scheme. The problem as well are the players and the agents. Always demanding more money or being offered ludicrous sums. How do the clubs pay for it. Things like this. Two hundred and seventy million pounds disappeared into agents pockets last season. Some of these agents are also far too powerful holding clubs almost to ransom and dictating where players will go.

    After going after the so called elite clubs the next step has to be tighter regulation of agents and more transparency in what they do.

    I fully agree Smudger - it is vital they get punishment for this or they will be back in 5 years time. Points deductions, european sanctions and fines for all involved. Let the idiots who instigated this feel the wrath of their fans for what they reap.
