The Home Office is the only body that can issue a work permit.

 

Is it not based on FA criteria though? Either way, if the first is rejected I don't see how an appeal could make a difference.

 

The Home Office probably liaised with the FA (as probably also the FAW, SFA and IFA) and agreed to the restrictions that are in place but the Home Office ultimately make the decision.

Plus there is a right to appeal to the Home Office, they have a special courthouse in Feltham for such appeal hearings.

 

I have no expertise or even knowledge of this particular process, but I do know something about how challenges and appeals work in this type of situation and I would hazard a guess that the argument might be made that the first decision failed to take proper account of relevant factors, eg that he should qualify through the 'exceptional talent' criterion and that the original decision paid insufficient evidence to the strong evidence put forward to justify such a conclusion. Bearing in mind that that judgment, as I understand it, is a matter of discretion rather than the simple application of rules, the latter only being challengeable if the first body had somehow misunderstood or misapplied those rules.

With the points system I would say we were close. I imagine he is in the top 25% of the highest paid at the club, if anything just to score him those points. I don't think he is in the top 25% of transfer fees though because if ridiculous fees from the top 6 clubs, which is where the whole 'preferential treatment' comes in.

He didn't play as many games at Udinese and Malaga as we would have liked which threw a massive spanner in the works. Had he played more, he would have scored more points. I imagine he was 1 or 2 points shy of hitting the 5 needed for a work permit.

Hopefully with the appeal he might sign.

If we weren't appealing then he would have been sent to a Spanish club by now so he could have his Spanish passport by January and return to us and play.

Venezuelan press say that he was operated on in Rome a couple of days ago and is out for at least 3 months. He's still on loan to Malaga as it was an 18 month loan and hasn't been cancelled. Article says he's in a bit of a tough position as we haven't agreed to cancel the loan but Malaga don't want him. They can't find anyone else to take the loan on though as he's out until October at the earliest. So unless we're successful in a work permit appeal and decide to add him to our squad, sounds like he'll stay at Malaga with them paying his wages until at least the January window.

 

What a ******* mess. Massive hinderance to his development. Feel he should have stayed on loan at Granada where he was actually being played, and playing well.

Agree. There's too many jobsworths at the Home Office especially now with brexit on the horizon, they'll all be looking for brownie points to keep their jobs.

how'd i do that?

took me a whilst realise. my computer became non-responsive 3 times until i realised the 2000+ count on my adblock. i ran a malware check and it came up with 2 threats, may have been there before though.

Only thing I can think so if we've been on the site for less time, maybe since the website was updated so we don't have those powers yet. I remember when I joined I had to wait hours for my posts for be approved.
